    1. Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and FreshRent Ltd ("FreshRent", "we", "our", or "us") governing your access to and use of the FreshRent platform, including our website at freshrent.co.uk, our application at app.freshrent.co.uk, and all related services (collectively, the "Service").

    By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

    2. Description of Service

    FreshRent provides a property inspection reporting platform that enables landlords, letting agents, and property managers to:

    • Create and manage property profiles
    • Conduct property inspections with photo documentation
    • Generate inventory, inspection, and checkout reports
    • Use AI-powered description enhancement
    • Record meter readings and defects
    • Export professional PDF reports
    • Collaborate with team members (on applicable plans)

    3. Account Registration

    To use certain features of the Service, you must register for an account. You agree to:

    • Provide accurate, current, and complete information
    • Maintain and promptly update your account information
    • Maintain the security of your password and accept responsibility for all activities under your account
    • Notify us immediately of any unauthorised use of your account

    You must be at least 18 years old to create an account and use the Service.

    4. Subscription Plans and Payments

    4.1 Plans

    We offer the following subscription tiers:

    • Free: 2 properties, 7-day report storage
    • Agent (£4.99/month): 10 properties, 14-day report storage
    • Agency (£19.99/month): 100 properties, 2 team members, 90-day report storage
    • Pro (£49.99/month): Unlimited properties, unlimited team members, 2-year report storage

    4.2 Billing

    Paid subscriptions are billed monthly in advance. All prices are in GBP and exclusive of VAT where applicable. Payment is processed securely through our payment provider, Stripe.

    4.3 Cancellation

    You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial months.

    5. Acceptable Use

    You agree not to:

    • Use the Service for any unlawful purpose
    • Upload content that infringes intellectual property rights
    • Upload malicious code or attempt to compromise the Service
    • Share your account credentials with others
    • Use the Service to store or transmit content unrelated to property inspection
    • Attempt to reverse engineer or decompile any part of the Service
    • Use automated systems to access the Service without permission

    6. Your Content

    You retain ownership of all content you upload to the Service, including photos, property information, and reports ("Your Content"). By uploading content, you grant us a limited licence to store, process, and display Your Content solely to provide the Service.

    You are responsible for ensuring you have the right to upload and use all content, including obtaining necessary permissions for property photographs.

    7. AI Features

    Our Service includes AI-powered features for enhancing property descriptions. While we strive for accuracy, AI-generated content is provided as a suggestion and should be reviewed before use. You are responsible for the final content in your reports.

    8. Intellectual Property

    The Service, including its original content (excluding Your Content), features, and functionality, is owned by FreshRent Ltd and is protected by copyright, trademark, and other intellectual property laws.

    9. Limitation of Liability

    To the maximum extent permitted by law, FreshRent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

    Our total liability shall not exceed the amount paid by you to FreshRent in the 12 months preceding the claim.

    10. Disclaimer of Warranties

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

    Reports generated through the Service are tools to assist with property documentation and do not constitute legal advice or professional inventory services.

    11. Indemnification

    You agree to indemnify and hold harmless FreshRent, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

    12. Changes to Terms

    We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

    13. Termination

    We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

    14. Governing Law

    These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
